The City of Loveland Planning & Zoning Commission will conduct a public hearing Monday, April 2, 2012, at and around 7:30 p.m. in the Council Chambers located at Loveland City Hall, 120 W. Loveland Ave., Loveland, Ohio 45140.
The purpose of the hearing is to receive public comments on text amendments to the City’s Zoning Code Section 1107.01 Definitions, Chapter 1173.04 Signs Not Requiring a Permit, Chapter 1173.10 O-R Office-Residential District Sign Regulations, 1173.13 H Historic District Sign Regulations, and Chapter 1174 Table of Permitted Signs. The proposed text amendments are associated with promotional signs and portable sandwich board signs. Information about the proposed zoning code text amendments is available for review in the City’s Building & Zoning Department during normal business hours, Monday through Friday.
Interested persons may appear and be heard with respect to the proposed amendment. Comments may also be submitted in writing to Eva Parker, Building and Zoning Supervisor, 120 W. Loveland Avenue, Loveland, OH 45140 or emailed to firstname.lastname@example.org.

This memorandum requests the Planning & Zoning Commission to schedule a public hearing to hear public comments for zoning text amendments associated with regulation of portable A-frame sandwich signs and temporary promotional signs.
On February 6th, the Planning and Zoning Commission adopted a motion to initiate a zoning text amendment for temporary promotional signs and portable A-frame sandwich signs and scheduled a public hearing date for March 5th for the proposed amendment pursuant to §1115.05 (b) of the ZoningCode. A notice of the March 5th public hearing was published in a newspaper of general circulation in the City a minimum of ten days prior to the meeting which set forth the time and place for the public hearing and the nature of the proposed text amendment and notice was properly served to the owners of the real property within the boundaries of the location of the proposed use.
Between the date of publication and March 5th, staff performed additional assessment of the proposed text amendments, specifically the design of the portable A-frame sandwich sign, and determine that more options should be considered before staff makes a recommendation to the Planning and Zoning Commission. Thus the public hearing schedule for March 5th was cancelled.
Portable A-frame sandwich signs are regulated in §1173.10, §1173.13 and Chapter 1174 of the ZoningCode. Many of the existing portable sandwich signs in the City violate one or more of these regulations.
On February 6th, the Planning and Zoning Commission adopted a motion to initiate a zoning text amendment for temporary promotional signs and portable A-frame sandwich signs pursuant to §1115.03(a)(1).
Pursuant to Codified Ordinance Section 1115.05, the Planning and Zoning Commission shall, after adoption of a motion with respect to a zoning text change, hold a public hearing to consider the zoning text change.
Staff recommends the Planning and Zoning Commission schedule a public hearing for 7:30 p.m. on Monday, April 2, 2012 in Council chambers.

Zoning Text Amendment, Chapter 1173 Signs and Chapter 1174 Table of Permitted Signs
Mr. Vidmar explained the reasoning behind the amendments. Mr. Vidmar stated that the signs this amendment would apply to would be A- Frame signs in the Historic amd Office-Residential districts. Mrs. Settell asked about the attendance at the June 15th public meeting for business owners in regards to the proposed amendment. Mr. Vidmar stated that only two business owners attended from the two districts that the notices were sent to. Mr. Vidmar also stated that he was in contact with numerous business owners who did not attend the meeting but were in favor of the proposed changes. Mrs. Settell said she had also talked to a few business owners in Loveland Shoppers Haven that were upset that they could not use A-Frame signs. Mr. Vidmar clarified that A-Frame signs were only allowed in the Historic and Office Residential Districts.

This memorandum requests that the Planning and Zoning Commission start (by way of a motion) the initiation of an amendment to the text of the City Zoning Code in Chapter 1173 Signs and Chapter 1174 Table of Permitted Signs.
During the past few years staff has seen a noticeable increase in the use of portable A-frame sandwich signs in the City’sHistoric and Office Residential Districts, particularly along W. Loveland Ave. Staff recognizes the importance of these portable signs and all signs erected to promote business and generate sales. City Council previously amended the zoning code to liberalize portable sandwich signs. However, many of the signs are hand painted, of varying quality, contrasting designs and constructed of materials that deteriorate rapidly. Moreover, there are multiple signs in similar locations on each lot and the excessive use of signs can prove counterproductive to the intended goal of signs, which is to identify businesses and activities to motorists and pedestrians.
While researching portable A-frame sandwich signs in the Zoning Code, staff also noticed the Loveland Zoning Code does not contain a suitable definition and regulations for temporary promotional signs.
Portable A-frame sandwich signs are regulated in §1173.10, §1173.13 and Chapter 1174 of the Zoning Code. Many of the existing portable sandwich signs in the City violate one or more of these regulations. In May, 2011 Staff sent a letter to the businesses and property owners located in the Historic and Office-Residential Districts suggesting that they consider using a sign design that is more attractive, more durable and consistent with the general theme of the Historic District. Staff recommended a sign design for them to use with the intention for the design to remain constant for each business. Staff offered for th eCity to pay for new portable sandwich signs that replace existing signs as regulated under current Chapter 1174: Table of PermittedSigns. Staff further specified that the City would not pay for new signs that are not intended to replace existing signs.
Staff held a public meeting on June 15, 2011, to which all the aforementioned business owners and property owners were invited, at which this topic was discussed. The feedback Staff eceived at this meeting was generally positive.
Pursuant to §1115.03(a) of the Zoning Code, the Planning & Zoning Commission may initiate a text amendmenttotheZoningCodebyadoptionofamotion. Subsequenttoitsadoptionofamotion,the Planning and Zoning Commission shall hold a public hearing to consider the zoning text amendment.
Within thirty-five (35) days after the close of the public hearing, the Planning & Zoning Commission shall recommend to Council, that the amendment be granted, as requested, or it may recommend a modification of the amendment or it may recommend the amendment not be granted. ThePlanning and Zoning Commission shall transmit its recommendation to Council.
Staff recommends the Planning and Zoning Commission adopt a motion to initiate a text amendment and schedule a public hearing for Monday, March 5th.
Mr. Vidmar added that the point of this amendment would be to add consistency and improvements to the A-Frame signage. Mr. Kressler then asked if there would be a standard detailed drawing for the businesses to use as a template. Mr. Vidmar responded by stating that there would be very clear standards and examples for the businesses to follow.
Mr. Hothem moved to set a public hearing for Monday, March 5, 2012 at or around 7:30 p.m. for Case No. 12-02 Zoning Amendment, Chapter 1173 Signs and Chapter 1174 Table of Permitted Signs, seconded by Mr. Prodromo.
